1. Acceptance of Terms

By accessing or using the Uplift Communities Medical Workforce Development Program platform ("Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Description of Service

The Platform provides access to healthcare workforce training materials, simulations, assessments, and program management tools as part of the Medical Workforce Development Program, a partnership between Uplift Communities and Kingsborough Community College (KCC), funded by the NYC Department of Youth and Community Development (DYCD).

3. Eligibility

To use the Platform, you must:

  • Be at least 18 years of age
  • Be enrolled in or accepted to the Medical Workforce Development Program
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms.

5. Acceptable Use

You agree NOT to:

  • Share your account credentials with others
  • Submit false or misleading information
  • Attempt to access other users' accounts or data
  • Use the Platform for any unlawful purpose
  • Interfere with the Platform's operation or security
  • Copy, distribute, or modify Platform content without permission
  • Use automated tools to scrape or collect data from the Platform
  • Share quiz answers, assessment content, or simulation scenarios with others

6. Educational Content

The educational content provided on the Platform is for training purposes only and does not constitute medical advice, diagnosis, or treatment. The Platform is designed to prepare you for healthcare certification programs but does not guarantee certification, employment, or any specific outcome.

7. Intellectual Property

All content, materials, software, and design elements on the Platform are owned by or licensed to Uplift Communities and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Program Participation

Participation in the Medical Workforce Development Program is subject to additional program requirements including but not limited to:

  • Maintaining minimum attendance requirements (80% as required by DYCD)
  • Completing required coursework and assessments
  • Adhering to program policies and codes of conduct
  • Submitting required documentation in a timely manner
  • Participating in scheduled interviews and check-ins

Failure to meet program requirements may result in removal from the program and loss of associated benefits including stipend payments.

9. Stipend and Payment

Stipend payments are contingent upon meeting program requirements and are subject to DYCD guidelines. Uplift Communities reserves the right to adjust or withhold payments for non-compliance with program requirements.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

11. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

To the fullest extent permitted by law, Uplift Communities shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or participation in the program.

13. Modifications

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated through the Platform or via email. Continued use of the Platform after changes are posted constitutes acceptance of the modified terms.

14. Termination

We may suspend or terminate your access to the Platform at any time for violation of these terms or program requirements. Upon termination, your right to use the Platform ceases immediately, though certain provisions of these terms will survive termination.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
